Terms of Service

1. GENERAL PROVISIONS

1.1. This Regulation defines:

  • The terms of use for 3D CAD Services and 3D Printing Services offered by Xtrude3D Jakub Mazurek.
  • The general conditions for the provision of 3D CAD Services and 3D Printing Services by Xtrude3D Jakub Mazurek.

1.2. Definitions:

  • 3D SERVICES REGULATION – this regulation.
  • SERVICE PROVIDER – Xtrude3D Jakub Mazurek, conducting business under the name Xtrude3D Jakub Mazurek, with its registered office at:

  • CLIENT – a natural person, legal entity, or an organizational unit without legal personality that has entered into or intends to enter into a 3D Service Agreement by placing an Order.
  • CONSUMER – a natural person entering into a 3D Service Agreement for purposes not directly related to their business or professional activity.
  • 3D MODEL – a file containing a three-dimensional model intended for 3D Printing or 3D CAD Service, provided by the Client or created by the Service Provider.
  • 3D PRINTING SERVICE – a service involving the production of a physical object based on a provided or designed 3D Model using additive manufacturing technologies.
  • 3D CAD SERVICE – a service involving the creation of a 3D Model based on:
    • Client specifications,
    • Technical documentation,
    • Sketches,
    • Technical drawings,
    • Concepts provided by the Client.
  • 3D OBJECT – a physical product created as part of the 3D Printing Service.
  • 3D SERVICE AGREEMENT – an agreement for the provision of 3D CAD or 3D Printing Services, concluded between the Client and the Service Provider upon Order confirmation.
  • 3D SERVICE FORM – a form or email message sent by the Client containing the necessary information for processing the Order, including the 3D Model if applicable.
  • ORDER – a declaration of intent made by the Client, directly aimed at concluding a 3D Service Agreement.
  • INDIVIDUAL ENTREPRENEUR – a natural person entering into a 3D Service Agreement without a direct connection to their professional activity, as determined by the scope of their registered business activity (according to the Central Register and Information on Economic Activity).

2. ORDERS

2.1. Order Placement Procedure

The Client may initiate the conclusion of a 3D Service Agreement by:

  • Sending an email to office@xtrude3d.eu,
  • Filling out and submitting the inquiry form, if available on the Service Provider’s website.

Submitting an inquiry does not constitute the conclusion of a 3D Service Agreement.

2.2. Required Information in the Order

When placing an Order, the Client must provide the following details:

For Consumers:

  • Full name,
  • Residential address (street, house/apartment number, postal code, city),
  • Email address,
  • Contact phone number.

For Clients who are not Consumers:

  • Company name,
  • Full name of the contact person,
  • Tax Identification Number (NIP),
  • Registered office address (street, house/apartment number, postal code, city),
  • Email address,
  • Contact phone number.

2.3. Order Processing Procedure

Upon receiving the inquiry, the Service Provider assesses its completeness and sends the Client:

  • A price estimate for the 3D Service,
  • The cost of shipping/delivery,
  • An estimated order completion time.

The Client may accept the offer by:

  • Sending a confirmation via return email,
  • Making the required payment, if a prepayment is necessary before execution.

The 3D Service Agreement is concluded once the Service Provider confirms acceptance of the Order.

2.4. Conditions for Order Rejection or Modification

The Service Provider reserves the right to:

  • Refuse an Order if it is incomplete or contains errors,
  • Request the Client to provide missing information,
  • Decline the Order if the 3D Model is incompatible, contains technical errors, or violates legal regulations.

In case of errors in the 3D Model:

  • The Service Provider may request the Client to correct them,
  • The Service Provider may offer to perform corrections as part of the 3D CAD Service (for an additional fee),
  • The Client may choose to proceed with 3D Printing despite the detected errors, assuming full responsibility for the final outcome.

2.5. Processing Multiple Orders

If the Client places multiple Orders, the Service Provider may execute them:

  • In separate batches,
  • According to an agreed delivery schedule.

3. ORDER CANCELLATION

3.1. Order Cancellation by the Service Provider

The Service Provider reserves the right to refuse or cancel an Order in the following cases:

  • The Client fails to make the required payment within the specified timeframe,
  • Technical errors in the 3D Model prevent the proper execution of the Service, and the Client does not agree to correct them,
  • The Client violates the provisions of the Service Regulations,
  • Unforeseen technical obstacles arise, making it impossible to complete the Service,
  • Concerns regarding the legality of the 3D Model or potential infringement of third-party rights.

If an Order is canceled, the Service Provider will notify the Client via email.

3.2. Order Cancellation by the Client

  • The Client may cancel an Order only before the Service execution has begun.
  • To cancel an Order, the Client must submit a written statement via email to office@xtrude3d.eu.
  • If the Service Provider confirms that the execution of the Service has not yet started, the cancellation is possible without additional costs.

3.3. Consequences of Order Cancellation After Execution Begins

  • Due to the personalized nature of 3D Services, the Client cannot cancel the Order once the execution has started.
  • If the Client withdraws after the Service has commenced, they are fully responsible for covering the costs of the Order, regardless of its stage of completion.

4. 3D MODEL

4.1. 3D Model Requirements

A Client submitting a 3D Model must provide the file in one of the supported formats:

  • STL, STEP, STP, OBJ, IGES, 3MF (or other formats upon prior agreement with the Service Provider).
  • Maximum file size: 50 MB.
  • The model must be properly prepared for printing – closed solid, error-free mesh, correctly scaled.

If the model contains technical errors, the Service Provider may:

  • Return the model for correction by the Client,
  • Offer a 3D CAD model correction service for an additional fee,
  • Proceed with printing despite errors, provided that the Client gives written consent and takes full responsibility for the final outcome.

4.2. Client’s Statement Regarding Copyright

  • The Client declares that they hold full copyright or appropriate licenses to use and reproduce the 3D Model.
  • The Client guarantees that submitting the Model to the Service Provider does not infringe any third-party rights, including:
    • Copyright,
    • Patents,
    • Trademarks,
    • Intellectual property protections.

If any third-party claims arise regarding copyright infringement, the Client assumes full liability.

4.3. 3D Models Excluded from Processing

The Service Provider reserves the right to refuse execution of an Order if the 3D Model:

  • Infringes copyright or third-party intellectual property rights,
  • Contains offensive, illegal, or unethical content,
  • Relates to the manufacturing of weapons, weapon parts, dangerous tools, or other potentially hazardous items,
  • May contain malicious software (e.g., viruses, trojans) embedded in the file metadata.

4.4. Restrictions on the Use of the 3D Model by the Service Provider

  • The 3D Model provided by the Client will not be used by the Service Provider for any purpose other than fulfilling the Order.
  • After completion, the 3D Model is stored for up to 30 days, after which it may be permanently deleted unless the Client agrees to its archiving.
  • The Service Provider is not responsible for storing the 3D Model after the completion of the Service.

5. PAYMENT METHOD

5.1. Payment Currency

  • Payments for ordered 3D Services are made in Polish zloty (PLN).
  • Upon the Client’s request, payment in Euro (EUR) may be possible if this option is provided by the Service Provider.

5.2. Payment Method

  • Payments for 3D Services in PLN must be made via bank transfer to the Service Provider’s designated account.
  • If the Service Provider allows payments in EUR, the Client must transfer the amount to the designated EUR account.

5.3. Payment Terms

  • The Client is required to make full payment in advance, unless stated otherwise in the 3D Service Agreement.
  • For individual arrangements (e.g., advance payment, deferred payment), specific terms must be outlined in the Order Confirmation.
  • Failure to make a payment on time may result in Order cancellation.

5.4. Payment-Related Fees

  • The Service Provider reserves the right to charge additional fees for certain payment methods, as per the terms of the payment operators.
  • Foreign transfer fees or bank charges are covered by the Client.

5.5. Invoices and Sales Documents

  • The Service Provider issues VAT invoices upon the Client’s request.
  • Invoices are delivered electronically to the email address provided in the 3D Service Form.
  • Acceptance of the Regulations constitutes consent to receiving invoices electronically.

5.6. Payment Deadline

  • The Client must complete the payment within 3 calendar days from the date of concluding the 3D Service Agreement.
  • Failure to pay within this timeframe entitles the Service Provider to:
    • Withdraw from the Agreement,
    • Claim reimbursement for costs incurred in the execution of the Service,
    • Charge statutory interest for late payment

6. TRANSPORT / SHIPPING

6.1. Scope of Delivery

  • The transport/shipping of the 3D Object is available within the territory of Poland and internationally, if this option is provided by the Service Provider.

6.2. Delivery Address

  • The 3D Object is delivered to the address specified by the Client in the 3D Service Form or in an email related to the Order.
  • The Client is responsible for providing correct and complete address details.

6.3. Transport/Shipping Methods

The Service Provider offers the following delivery options:

  • Courier shipment – delivery via a courier company chosen by the Service Provider.
  • InPost parcel lockers (if available).
  • Delivery by the Service Provider – upon prior agreement of terms.
  • Personal pickup – possible after arranging the date and location in advance.

6.4. Transport/Shipping Costs

  • The shipping costs are communicated to the Client before placing the Order.
  • The shipping fee may vary based on size, weight of the 3D Object, and delivery location.
  • For international shipments, shipping costs are determined individually.

6.5. Estimated Delivery Time

  • The estimated shipping date of the 3D Object is provided to the Client before placing the Order.
  • The Service Provider is not responsible for delays caused by courier companies or other delivery operators.

6.6. Shipment Liability

  • The Service Provider is responsible for the shipment until it is handed over to the courier company.
  • Once the 3D Object is transferred to the carrier, the risk of damage or loss shifts to the Client.
  • The Client should inspect the shipment upon delivery and, in case of damage, immediately prepare a damage report in the courier's presence and submit a complaint.

7. COMPLAINTS / LIABILITY – CLIENTS OTHER THAN CONSUMERS / INDIVIDUAL ENTREPRENEURS

7.1. Exclusion of Warranty Rights

  • For Clients who are not Consumers or Individual Entrepreneurs, the provisions regarding statutory warranty (rękojmia) are excluded.

8. COMPLAINTS / LIABILITY – CONSUMERS / INDIVIDUAL ENTREPRENEURS

8.1. Quality Assurance

  • The Service Provider guarantees that the 3D Object delivered to the Consumer will be free from defects.

8.2. Complaint Submission Period

  • A Consumer has the right to submit a complaint within 12 months from the date of receiving the 3D Object from the Service Provider.

8.3. Complaint Submission Methods

A complaint can be submitted via:

  • Written statement sent to the Service Provider’s address:

  • Email sent to: office@xtrude3d.eu

8.4. Complaint Procedure

To process the complaint, the Consumer must:

  • Return the defective 3D Object via courier shipment to the Service Provider’s address,
  • Deliver it in person to the Service Provider’s headquarters after prior appointment.

8.5. Required Complaint Details

The complaint should include:

  • Information and circumstances regarding the subject of the complaint, particularly the type and date of the defect,
  • The Consumer’s request (e.g., replacement, repair, refund),
  • Consumer’s contact details to facilitate and expedite the complaint resolution process.

8.6. Request for Additional Information

  • If the complaint is incomplete, the Service Provider will request the Consumer to provide the missing details within a maximum of 3 days from receiving the request.

8.7. Response Time for Complaints

  • The Service Provider will respond to the Consumer’s complaint without undue delay, no later than 14 calendar days from the date of submission.
  • The response will be sent via email to the address provided in the 3D Service Form.

8.8. Applicability to Individual Entrepreneurs

  • The provisions of Sections 8.1 - 8.7 also apply to Individual Entrepreneurs.

9. WITHDRAWAL FROM THE AGREEMENT

9.1. Right to Withdraw from the Agreement

  • The Client has the right to withdraw from the 3D Service Agreement by sending an email to the Service Provider before the production of the 3D Object has begun.

9.2. Consequences of Withdrawal After Production Starts

  • If the Client withdraws from the Agreement after production has begun, they are obligated to pay the full price of the 3D Object.

9.3. Exclusion of Right of Withdrawal for Consumers / Individual Entrepreneurs

  • Consumers and Individual Entrepreneurs do not have the right to withdraw from the Agreement without providing a reason, as per Article 27 of the Polish Consumer Rights Act of May 30, 2014, due to the custom nature of the service, which is carried out according to the Client’s specifications

10. PERSONAL DATA

10.1. Data Controller

  • The data controller is Xtrude3D Jakub Mazurek, with its registered office at:

10.2. Privacy Policy

11. FINAL PROVISIONS

11.1. Availability of the 3D Service Regulations

11.2. Integral Part of the Agreement

  • The 3D Service Regulations form an integral part of the 3D Service Agreement.

11.3. Amendments to the Regulations

  • The Service Provider reserves the right to modify the 3D Service Regulations.
  • Any changes take effect on the date specified by the Service Provider, but no earlier than 7 days from the date of their publication on www.xtrude3d.eu.

11.4. Alternative Dispute Resolution for Consumers

11.5. Governing Law

  • In matters not regulated by these 3D Service Regulations, the applicable provisions of Polish law shall apply.
